INTRODUCTION

This cause is before the court on the Plaintiffs Motion for Summary Judgment, filed on November 12, 1993. The defendant has responded to plaintiffs arguments, and both sides have submitted cases from other jurisdictions that support their positions.

The plaintiff originally brought suit in the Circuit Court of Montgomery County, Alabama. Defendant removed the action to this court pursuant to the court’s federal question jurisdiction as set forth in 28 U.S.C. § 1441(a) and 28 U.S.C. § 1331. The court finds that jurisdiction is proper as…
