The plaintiff, State Farm Fire and Casualty Company (hereinafter “State Farm”) has brought a suit for money had and *236received against the defendants for the recovery of fire losses paid under Homeowners’ Policy No. 46-027-9670-6. After the commencement of this case the defendants filed their petition for relief under Chapter 11 of the United States Bankruptcy Code.
