Appeal from a judgment of tbe superior court for Walla Walla county, Brents, J., entered October 28, 1904, upon a trial and conviction of tbe crime of rape.

On October 11, 1904, tbe appellant was informed against for tbe crime of rape, alleged to have been committed on October 10, 1904, on tbe person of a female child of tbe age of thirteen years. On arraignment be pleaded not guilty, and, in tbe due course of procedure, was put upon bis trial.
Tbe evidence on tbe part of tbe state tended to show that tbe appellant commenced criminal relations with tbe girl some three months prior to tbe time tbe information was filed against him, and that these were continued down *549to the time of his arrest.
