Mikesell filed his petition in the district court of Wilson county, in which he alleged the formal facts requisite and, in substance, further alleged that in August, 1905, at which time he was the legally appointed, duly qualified and acting assistant attorney-general in and for Wilson county, and was empowered to inform of and prosecute violations against the prohibitory liquor law, he filed in the district court thereof an information charging one George Ellis with having committed fifty-two separate and distinct violations of such law;…
