Background
On April 4, 2014, Plaintiff Laboratory Corporation of America Holdings (“LabCorp”) filed a post-award bid protest challenging the award of a contract by the Department of Veterans Affairs (“VA”) to provide laboratory testing and analysis services at five VA Medical Centers in upstate New York. The VA requested offerors to submit prices for 1,575 different laboratory tests based upon the VA’s “FY 2014 estimated utilization” level for each test.
