SCHOELEN, Judge:
The appellant, Orland R. Marsh, through counsel, seeks review of an August 23, 2002, Board of Veterans’ Appeals (Board or BVA) decision that determined that he had failed to submit a timely Notice of Disagreement (NOD) as to a VA regional office’s (RO’s) March 1994 denial of his service-connection claims. Record (R.) at 1-9. The appellant and the Secretary both filed a brief. This appeal is timely, and the Court has jurisdiction over the case pursuant to 38 U.S.C. §§ 7252(a) and 7266.
