In an action for the partition of real property between parties formerly wife and husband, the defendant husband appeals from an order, of the Supreme Court, Kings County, dated October 28, 1960, which denied his motion for summary judgment, granted summary judgment to the plaintiff wife and directed a reference to ascertain the respective rights of the parties in the property. Order affirmed, with $10 costs and disbursements. No opinion. Beldoek, Acting P.
