This was a suit instituted by the Dallas Consolidated Electric Street Bailway Company against the City of Dallas, its Mayor, Board of Commissioners and its Secretary, to enjoin them from canvassing the returns and declaring the result of a certain election held in the city of Dallas on April 22, 1912, at which an ordinance prescribing the fares to be charged passengers of street railway companies operating in that city, and regulatory of the carriage of passengers and the operation of cars, was submitted to the qualified voters and voted upon under the article of the city’s charter providing…
