Before the court are cross Motions for Summary Judgment on Plaintiffs Amended Complaint. The underlying facts of this case are not disputed, although some relevant matters do not appear to be of record. Plaintiff filed a voluntary petition in proper person under Chapter 7 on July 29, 2010. 1 Notice of Debtor’s bankruptcy filing was sent to all scheduled creditors by the Bankruptcy Noticing Center on July 31 and August 1, 2010.
