HOFFMAN, Judge:

Appellant contends that the Commonwealth failed to produce sufficient evidence to establish his guilt beyond a reasonable doubt. 1 We agree and vacate the judgment of sentence and, therefore, order appellant discharged.

On May 27, 1976, a Philadelphia police officer arrested appellant and charged him with possession of an instrument of crime. 2 On January 26, 1977, a non-jury trial commenced in the Philadelphia County Court of Common Pleas.
