This matter came before the court on November 29, 1993, pursuant to the plaintiffs declaratory judgment action. After having heard oral argument in this matter, the court took the matter under advisement and hereby renders a decision as follows.

On November 13, 1993, defendant Jeffrey Snider was acting as a referee for a tournament soccer match being held by plaintiff Clermont Central Soccer Association.
