On February 9, 2015, relator Gene Tim-berlake, individually and on behalf of the Estate of Joan Hughes Timberlake, filed a petition for writ of mandamus in this Court,. See Tex. Gov’t Code Ann, § 22.221 (West 2004); see also Tex. R. App. P. 52. In the petition, relator asks this Court to compel the Honorable Mike Wood, presiding judge of the Probate Court No. 2 of Harris County, to vacate the trial court’s September 18, 2013 order granting a new trial and to reinstate the trial court’s June 14, 2013 final judgment.
