C. E. Rims, the appellee, filed his bill in equity in the Circuit Court of Leon county against A. S. Rims, in which he alleges that on the 11th day of February, 1874, the defendant and orator formed a copartnership to he carried on in the firm name of A. S. & C. E. Rims for the purpose of manufacturing and selling lumber. That they were to he equal partners and each was to furnish one-half the funds necessary to commence the business.
