On December 15th, 1916, an indictment was filed in the Circuit Court' of Duval County against the plaintiff in error charging him with rape of one A. W. L., a female child under the age of ten years. To this indictment the plaintiff in error filed a plea in bar which alleges in substance that in August 1916, in the Criminal Court of Record in and for Duval County an information was .filed against him charging him with the offense of assault with intent to commit rape upon the said A.
