BROWN, Associate Justice.

Kansas & Gulf Short Line Railway Company, being a corporation duly incorporated, on the 4th day of May, 1887, made, executed, and delivered to a trustee a mortgage to secure certain bonds issued by the company, all of which bonds had been sold and delivered to the purchasers before the passage of the act of the Texas Legislature amending the Act of 1887 on the subject of “ receivers,” approved the 19th day of March, 1889. Acts 21st Leg., 55.

On the 13th day of May, 1889, suit was filed in the Circuit Court of the United States at Tyler, to foreclose the said mortgage,…
