MUNSON, District Judge.
This court is today presented with the difficult task of first determining the nature and extent of the privacy rights of inmates who have tested positive for exposure to the Human Immunodeficiency Virus (HIV) 1 and then balancing that privacy interest against the asserted interest of the New York State Department of Correctional Services (“DOCS”) in establishing a dormitory to house such inmates, all of whom will be transferred there involuntarily.
