The opinion of the court was delivered by

On the 9th day of July, 1895, the city council of the city of Cape May passed ■ the following ordinance, to wit:
“An ordinance requiring the use of fenders on all passenger ears operated by trolley or electric power in the streets of the city of Cape May.
“ Section 1. Be it ordained and enacted by the inhabitants of the city of Cape May in city council assembled, and it is hereby enacted by the authority of the same, That hereafter all passenger cars operated by trolley or electric power in the streets of the city of Cape May shall have…
