GORTON, District Judge.

Presently before the Court is a motion for an evidentiary hearing and a petition for a writ of habeas corpus, both filed, pro se, by Joseph A. Phillips (“Phillips”). On July 18, 2006, United States Magistrate Judge Marianne B. Bowler filed a Report and Recommendation that the petition should be denied. On August 3, 2006, Magistrate Judge Bowler supplemented her report by recommending that the motion for evidentiary hearing should likewise be denied.
