This action for declaratory relief results from an accident which occurred on November 24, 1994, in Scott County, Virginia. The complainant, Linda Joyce Thompson, a Tennessee resident, filed a federal court complaint on November 5, 1996, against the defendant, Jerry Lynn Stallard, a Virginia resident. Stallard was insured by Virginia Farm Bureau with a policy limit of $25,000, and after being served, Virginia Farm Bureau failed to file an answer to the complaint.
