MEMORANDUM AND ORDER
WEBSTER, District Judge.
This is an action for review of Award 21562 of the National Railroad Adjustment Board dated October 14, 1970, based upon the decision of a Special Board of Adjustment, No. 741, formed pursuant to an agreement between the parties in accordance with the provisions of 45 U.S.C.A. 153, Second. Petitioner complains that the National Railroad Adjustment Board failed to make an award in his favor and asks this Court to hear and determine the grievance on its merits, render judgment as should have been rendered by the National Railroad Adjustment Board, or…
