MEMORANDUM RULING
PAYNE, United States Magistrate Judge.
Introduction
Mary Bryan Hill (“Plaintiff’) commenced this action in state court against defendants Hom/Ade Foods, Inc. and its president, Howard Burris. Plaintiff alleges that Hom/Ade and Burris violated Louisiana law by marketing and selling products throughout Louisiana under the name of “Mary B’s”, a trade name that Plaintiff registered with the Louisiana Secretary of State in 1995. Plaintiff invokes La.R.S. 51:222 and 223 and requests that the court permanently' enjoin the defendants from using the “Mary B’s” trade name in Louisiana.…
