In this case the plaintiff in error, Marion Mendenhall, was charged with the crime of murdering Alexander Nowlin, alleged to have been committed in Howe, Le Flore county,, Okla., on the 30th day of March, 1918. At the trial, in due course, a verdict of manslaughter in the first degree was rendered against plaintiff in error, and judgment and sentence were entered accordingly, on the 29th day of November, 1918, fixing his punishment at confinement in the penitentiary for 21 years.
