We granted certiorari to the Court of Appeals of Georgia 1 to determine whether the 1997 amendment to OCGA § 9-11-9.1 requires an expert affidavit to be filed against an employer, other than a licensed health care facility, which is alleged to be liable based upon the action or inaction of its agent or employee who is a professional licensed by the State of Georgia and listed in subsection (f) of that code section. 2 The court of appeals held that the 1997 amendment to OCGA § 9-11-9.1 (a) did not change existing law with regard to claims of professional negligence…
