On February 11, 1936, Louis B. Hatke filed, in the clerk’s office of the Circuit Court of Augusta county, his notice of motion for judgment against the Globe Indemnity Company, a foreign corporation. The notice was returnable on March 2, 1936, and on that day a judgment by default was awarded *185Hatke by the court for $1,057.15, the defendant, Globe Indemnity Company, not appearing.
