■On May 25, 1873, tbe defendant in error, Wood, executed a bond for $140.00, payable one day after date to Allison, plaintiff in error’s "testator, at wbicb time botb tbe obligor and obligee resided in Washington county, Virginia. Allison died in tbe year 1879, and tbe same, year Wood removed from Washington county and settled in tbe Valley of Virginia, where be remained until tbe year 1883 or 1884, when be became .a resident of tbe State of North Carolina.
