BOND, Chief Justice.

The appellee, Virgil E. Hampton, plaintiff in the court -below, brought this suit against appellant, National -Casualty ■ Company, defendant, to recover disability and hospitalization benefits, penalty, interest, and attorney’s fee alleged to 'be -due him under a health and accident policy issued by the defendant company.
