OPINION AND ORDER

PIERAS, Senior District Judge.

Currently pending before the Court are defendant’s Motion to Dismiss Pursuant to Fed.R.Civ.P. 12(b)(6) (docket No. 18) and plaintiffs opposition thereto (docket No. 20). This Court has jurisdiction to adjudicate this dispute pursuant to 28 U.S.C. § 1331.
