The case was tried before Brill, J., who made findings and ordered judgment in favor of plaintiff for $720.18. This is an action by the trustee in bankruptcy of one Grossman to recover a sum of money received by the defendant Wilson Brothers upon an execution in its favor against Grossman upon the ground of a preference. There were findings for the plaintiff. The defendant appeals from an order denying its motion for a new trial.
