The sheriff of Albany county has appealed from an order of the Albany Trial Term of the Supreme Court sustaining a writ of habeas corpus and discharging relator from his custody.

During the month of November, 1938, at the request of the Attorney-General, Mr. Justice Hinkley, a justice of the Supreme Court, was assigned to sit as a committing magistrate in Albany county for the purpose of inquiring into certain alleged election irregularities then under investigation by the Attorney-General.
