In February, 1921, W. T. Dunn was killed in Iberville parish,' La., while an employee assisting in the operation of a Texas & Pacific train engaged in interstate commerce. Dunn, together with his wife and two children, resided at that time in Jefferson parish, La., over 309 miles from Harrison county, Tex., where this litigation originated. The Texas & Pacific Railroad, of which the appellants are receivers, runs from New Orleans, La., into the city of Marshall, the county site of Harrison county, Tex.
