This is a suit in the form of trespass to try title, brought by J. F. Bland and others against W. C. Turnbow, in which the State of Texas intervened as a party defendant. The suit is principally one of boundary. It is what is sometimes referred to as a vacancy suit. Plaintiffs were the landowners and those claiming mineral interests under them. Turnbow and the State sought to establish a vacancy 50 varas wide between the east line of the David Ferguson Survey and the west line of the G. W. Hooper.
