This action was one by a purchaser of a quarter section of land in Rice county for $11,700 against a bank, which was an escrow holder of the papers under the contract between the purchaser and the vendor, to recover damages for the failure and refusal of the escrow-holder bank to accept the offer of the pur*473chaser of his final payment with interest under the contract made more than four years and five months after such payment by the terms of the contract was due and payable and the refusal of the bank to deliver to the purchaser the deed…
