On November 15, 1933, the plaintiff while riding with the defendant Michaud in his Chevrolet automobile as his guest, received personal injuries when his car collided with a truck owned by defendant Dow and operated by defendant Malzac. Suit was brought against Dow as the owner and Malzac as the operator of the truck, alleging negligence by each in the operation of the truck, and against Michaud, alleging gross negligence by him in the operation of his ear.
