delivered the unanimous Opinion of the Court:

This action was brought against the State Highway Department to recover damages for injuries sustained by the plaintiff on account of an obstruction which the defendant is alleged to have negligently permitted to remain upon a street constituting a link in the state system of highways within the corporate limits of the town of Lanes. The defendant demurred to the complaint upon the ground that it failed to state a cause of action, in that the State Highway Department was discharged from any liability under the facts…
