Pro se litigant, Gerald W. Clemente, a federal prisoner incarcerated at the United States Prison in Terre Haute, Indiana, brought this action against the defendants under Bivens v. Six Unknown Named Agents of the Federal Bureau of Narcotics, 403 U.S. 388, 91 S.Ct. 1999, 29 L.Ed.2d 619 (1971). The district court dismissed the action without prejudice on the basis of Heck v. Humphrey, 512 U.S. 477, 114 S.Ct. 2364, 129 L.Ed.2d 383 (1994). Clemente also filed an “order for mandamus” contending that his sentence had been miscalculated by the Federal Bureau of Prisons.
