Dario Bargas, Jr., brings this appeal from the trial court’s denial of his petition to expunge his criminal record following Bargas’s acquittal by a jury. We reverse and remand.
I. BACKGROUND
A grand jury indicted Bargas for attempted murder and aggravated assault on May 25, 2000. The matter proceeded to a jury trial in the 36th Judicial District Court, San Patricio County, Texas. On January 30, 2001, the jury returned a verdict of not guilty. A judgment acquitting Bargas of all charges was entered January 30, 2001.
