MEMORANDUM OPINION AND ORDER

TODD, District Judge.

Defendants have filed a motion to dismiss on the grounds that this court lacks subject matter jurisdiction to hear this cause of action. For the reasons set forth herein, this motion is granted in part and denied in part.

The original complaint in this case was filed on April 27, 1982, by thirty named plaintiffs on behalf of themselves and others similarly situated.
