OPINION
DAVID A. SCHOLL, Bankruptcy Judge.
Although we overcame significant procedural hurdles to reach the merits of the case before us, and the equities of the matter appear to favor such action, we must conclude that we cannot act herein to grant the Plaintiff relief on the merits.
