ORDER AND REASONS
DUVAL, District Judge.
Before the Court is a Motion for Dismissal of Second Amended Complaint (Doc. No. 33) filed by the United States. Oral argument was conducted on January 12, 2005. This case arises out of an incident which occurred on October 30, 2001 aboard the MW SAKURA I which was owned and operated by Guilford Navigation and North and South American Shipping. (Second Amended Complaint, Amended Par. III).
