Petitioner seeks the issuance of a writ of habeas corpus under the provisions of 28 U.S.C. § 2254. He presently is a prisoner in state custody at the Menard Correctional Center, Menard, Illinois. This action was commenced in the United States District Court for the Eastern District of Illinois. Petitioner was granted leave to proceed in forma pauperis by Judge James L.
