Tbis is an application by C. H. Miller, a former commissioner, to have tbe Court consider and pass upon certain exceptions noted by bim in tbe progress of tbe case in tbe court below, on the ground that on appeal the cause bad been retained and was now in tbis Court for tbe purpose indicated.
