A new trial has been had of this proceeding in accordance with the order of reversal of the Appellate Division. (Matter of City of New York [Sixth Ave. El. R. R.], 265 App. Div. 200.) The trial was divided into two hearings. It was first necessary to determine whether the Sixth Avenue line was capable of profitable operation and if that were found to be the fact then the court was to determine the value of the railroad as a going concern and find the amount of award which should be made.
