Adams Sanitation Company appeals from an order of the Environmental Hearing Board (Board) which made final its previous order granting partial summary judgment in favor of the Department of Environmental Protection (Department).1
The facts are as follows. On July 22,1977, Adams Sanitation Company (ADSCO), entered into a lease with Netta S. Deatrick to operate a sanitary landfill on an approximately 108 acre site owned by Deatrick in Tyrone Township, Adams County.
