This was an action brought upon a surety bond given to the Borough of Castle Shannon by the Liberty Construction Company, as principal and the Continental Casualty Company as surety, in connection with a contract with the Borough wherein the Construction Company agreed to construct a sanitary sewer. There were three surety bonds given, one for the performance of the contract; the second for the maintenance of the improvement and the third for labor and materials entering into the improvement, the present suit being upon the last named bond.
