I. INTRODUCTION

The plaintiff, John Amirault ("Amirault" or "Plaintiff"), has been employed by the City of Malden, Massachusetts (the "City"), for over 36 years, and as a law enforcement officer for over 31 years. At all relevant times, up until the present, he has held the rank of Captain.
