In this CPLR article 78 proceeding petitioner Samir Hashmi seeks to obtain records from the New York City Police Department (NYPD) pursuant to the state’s Freedom of Information Law (Public Officers Law § 84 et seq. [commonly referred to as FOIL]). The records sought in Hashmi’s October 2012 FOIL request pertain to alleged surveillance and investigation by the NYPD of Hashmi, and of the Rutgers University Muslim Student Association where he served as treasurer while enrolled as a student at Rutgers.
