The bill of complaint charges the defendant with the infringement of two letters patent granted to Boland H. Smith, — one dated November 17, 1885, and numbered 380,747, for a “process of producing illuminating gas;” and the other dated May 4, 1886, and numbered 341,354, issued upon an application made after the grant of the former patent, for a “process of manufacturing gas.” But the witnesses on both sides agree that the two patents cover substantially the same process, and as this, undoubtedly, is the fact, in treating the case, attention need only be given to the specification and claim of…
