Error to the Court of Civil Appeals, Sixth District, in an appeal from Lamar County. Mrs. Bobinson and others sued the railway company and recovered judgment: Defendant appealed, and on affirmance obtained writ of error. The case on former appeal is reported in 53 Texas Civ. App., 12.

This is an action by Mrs. Anna Robinson in her own right and as next friend of her minor children, Winnie and William Robinson, to recover damages in the sum of Twenty-five Thousand ($25,000) Dollars, against the Paris & Great Northern Railroad Company in the District Court of Lamar County, for the alleged negligent killing of W. I. Robinson on November 2, 1905, the husband and father of plaintiffs respectively.

As grounds of negligence on the part of the defendant, the plaintiffs alleged that the said W. I. Robinson on November 2, 1905, in Paris, Texas, “got aboard one of defendant’s . cars…
