Bell, Judge:

At the January, 1989, term of General Sessions for Cherokee County, Emmett Ray Nall was indicted with his brother, Anthony Wayne Nall, on ten counts of breaking into a motor vehicle, one count of grand larceny, one count of malicious destruction of personal property, and one count of assault and battery with intent to kill. The Nalls were tried together before a jury. At the close of the State’s case, the trial judge granted the Nalls a directed verdict of acquittal on eight counts of breaking into a motor vehicle.
