I. Background
The plaintiffs in this case brought suit against the Town of Spencer (the “Town”) and the members of its Board of Selectmen (the “Board”) for injuries arising out of the termination of their employment as part-time police officers in the Town. The plaintiffs filed a nine-count complaint alleging 1) violation of their due process rights pursuant to 42 U.S.C. § 1983 against the Town and the Selectmen as individuals, 2) violation of the Massachusetts Civil Rights Law, M.G.L. c. 12 §§ 11H and I, 3) breach of contract, 4) libel and slander,…
